US citizen with UAE company — does FATCA make banking harder?

Hi, I'm Joy from the United States. I'm setting up a company in the UAE. Will being a US citizen make it harder to open a business bank account because of FATCA?

The short answer is yes, but it doesn't mean you can't open a UAE business bank account. FATCA (Foreign Account Tax Compliance Act) requires banks worldwide, including those in the UAE, to identify and report accounts connected to US taxpayers. Because of these obligations, banks usually carry out additional compliance checks for US citizens.

Here's what you can expect:

  • Additional documentation: Banks may ask you to complete IRS forms such as Form W-9 and provide your US Tax Identification Number (TIN).
  • Longer processing times: Applications involving US shareholders often go through extra compliance reviews before approval.
  • More detailed due diligence: Banks may request information about your business activities, source of funds, expected transactions, and US tax compliance history.

The good news is that many established UAE banks are familiar with FATCA requirements and regularly onboard US-owned businesses. The key is ensuring your documents are complete and your tax information is consistent.

A client of ours from California recently incorporated a UAE consulting company. His application took a little longer than average because of the additional FATCA review, but once the required tax forms and supporting documents were submitted, the account was successfully approved without any issues.

If you're a US citizen planning to start a UAE business, I'd recommend working with a bank that has experience handling international clients and preparing your compliance documents before you apply. That usually makes the process much smoother.
